In November of last year, when Donald Trump became our president-elect, most of the world felt as if it had shifted in an unprecedented way.  Whether citizens supported Trump or did not, there was a common feeling of either joyous or defeated disbelief.

It wasn’t long after that a list of Trump’s initiatives appeared for his first 100 days in office.  With the support of a Republican majority in Congress, Trump’s initiatives suddenly seemed plausible. I saw this as an opportunity to look more closely at the checks and balances that exist in local, state and federal government.

We jumped quickly into action, creating a google document (so that citizens could collaborate) that outlines Trump’s initiatives so to better explore their context and, to identify local and New York State policies and laws that could help guide us through this new administration.   We hosted very small meetings with a couple dozen citizens to start this important work and realized shortly after that it needed to continue and be open to more citizen’s input.

The result is an educational series that will span 2017. Citizens can expect an array of subjects with expert panelists, a question and answer period,  an interactive work session on KingstonCitizens.org’s document “Trump Initiatives and NYS Local/State Policy and Laws” and short tutorials to help navigate the City of Kingston’s municipal website.

About Kate Hudson, Esq.:   As the Western U.S. Advocacy Coordinator, Kate supports advocacy teams with all U.S. western domestic campaign activities including policy, legislative, communications, investigations, fundraising and legal work. She develops and coordinates partnerships with local, state and national organizations working on water-related issues and coordinates with Waterkeeper organizations, affiliates, and partners on campaign efforts in the Western U.S.

Kate began her environmental career working in the Regional Attorney’s office of the NYS Department of Environmental Conservation in 1985, handling a wide range of enforcement and permitting matters in all program areas, including air quality, water quality, solid and hazardous waste and mining. In 1994 and 1995, she served as the Acting Regional Attorney.  In 1999, Kate left the DEC and was appointed an Assistant Attorney General in that office’s Environmental Protection Bureau. She was a member of the Bureau’s Hudson River Team, and was responsible for preparing the State and Federal Trustees natural resource damage claim against General Electric, for their contamination of the Hudson River with PCBs. Kate rejoined the NYS DEC in 2007 where she created and staffed a ten person unit dedicated to pursuing claims for natural resource damages against a wide variety of polluters for their discharges of hazardous substances and petroleum. As Director of the unit, she developed policy and budgetary documents in support of the Department’s natural resource initiatives, represented the Department in the development of claims, coordinated assessment and litigation activities with Federal Trustee agencies and Indian Tribes, and negotiated settlements with responsible parties.

In February 2011, Kate joined Riverkeeper and worked as its NYC Watershed Program Director and then Director of Cross-Watershed Initiatives until November 2016. Kate headed Riverkeeper’s efforts to build a powerful partnership and advocacy campaign with anti-fracking advocacy groups across New York State which resulted in the NYS Departments of Health and Environmental Conservation December 17, 2014 recommendation to not allow high-volume hydraulic fracturing in New York.  Kate and the Watershed Team also fought against NYC’s practice of muddy discharges from its Ashokan Reservoir to the Lower Esopus Creek as a turbidity control mechanism for the NYC water supply. After a three-year campaign for an environmental review of these discharges, the state DEC has committed to ensuring a comprehensive review process going forward. Finally, under Kate’s leadership, Riverkeeper initiated a cross-program campaign against the exponential increase in crude oil transport down the Hudson River Valley and the formation of a broad coalition of environmental organizations to oppose that expansion. That campaign has resulted in bringing to halt a state DEC permitting process that was on a fast track to allow the transport of heavy tar sands crude down the Hudson River.

About Andrea Callen, Esq.:  Andrea is an attorney and the program director at the Worker Justice Center of New York where she oversees the delivery of legal education and advocacy services throughout the state for low-wage workers in the areas of labor and employment rights, immigration policy, human trafficking and domestic and sexual violence. Prior to working at WJCNY, Ms. Callan was the Statewide Advocacy Coordinator at the ACLU of New York (NYCLU) where she was responsible for managing statewide legislative and policy advocacy campaigns focused on the areas of immigrants’ rights and immigration enforcement, farmworker labor rights, and women’s rights. Through her career, Ms. Callan has also served as the Chapter Director of the Suffolk County Chapter of the NYCLU and worked as a litigator in the areas of labor and employment discrimination law and civil rights law.

About Robin Jacobowitz, Ph.D.: Robin Jacobowitz is the director of education projects at the Benjamin Center at SUNY New Paltz. She taught for many years as an adjunct in SUNY New Paltz’s School of Education. Previously, Jacobowitz worked at New York University’s Institute for Education and Social Policy, where her research centered on the growth and development of charter schools in New York State, the organizational structures that facilitate teaching and learning in New York City small high schools, and leadership transitions in new schools in New York City. She also worked with the University of Chicago’s Chapin Hall Center for Children, where her research focused on the relationship between constituency building and policy work in affecting systemic school reform in New York State. Prior to beginning her career in research, Jacobowitz worked with the Public Education Network in Washington D.C., where she provided technical assistance to local education funds around the country on issues of school governance, school health, and public engagement. Jacobowitz holds an M.Ed. in education policy from the Harvard University Graduate School of Education, and a Ph.D. from the Robert F. Wagner Graduate School of Public Service at New York University. She is currently a trustee on the Kingston City School District Board of Education and a member of the executive committee of the Ulster County School Boards Association.

About James F. Shaugnessy, Jr.: James joined the Kingston City School District’s Board of Education because he felt he could make a positive contribution. “I have a daughter who attends school in the District. I wanted to make sure I felt comfortable with the School Board leadership of the District and that the philosophies practiced would be compatible with an environment I would want for my daughter.” In addition, James believes, “The Board also has a responsibility for looking forward to the future needs of the District.”  If James could achieve any educational goal while serving as a Board of Education member, it would be to see excellent programs implemented for all students so that each student can reach his or her maximum potential.  Current Board committee involvement includes serving Chair of the Audit Committee, as well as a member of the Jefferson Committee and the District Comprehensive Improvement Plan Committee.

About Callie Mackenzie Jayne:  Callie is the Lead Organizer for Citizen Action of New York’s Hudson Valley Chapter. She came to the Hudson Valley after growing up as a black person in a predominantly white, affluent town. Struggling with exclusion due to income, racial status, and high suspension rates, Callie began organizing around issues of gender equality, worker’s rights, and racial justice. Her focus began to shift as a result of her experiences moving to and living in low-income communities as a single mother in her early twenties.

During this time, she discovered the institutionalized issues that were preventing her from moving up and put her focus into finishing her undergrad and graduate degrees in order to provide leadership and promote change for others facing the same struggles. Having experienced first-hand many of the challenges and roadblocks faced by the communities we organize, Callie is able to connect with people on the basis of shared life experiences, while simultaneously providing strategy and organizing skills to help people take action on the issues that directly affect their lives.

Kingston, NY – Pilgrim Pipeline Holdings, LLC has proposed to construct two parallel pipelines that would run along the NYS Thruway and through private property—one pipeline carrying Bakken crude oil south from Albany, NY, to a refinery in Linden, NJ, and the other carrying refined products north. The 170+ miles of pipelines, together with nearly 13 miles of lateral pipelines, would impact 31 communities in Albany, Rensselaer, Greene, Ulster, Orange, and Rockland counties, as well as 30+ communities in New Jersey. The carrying capacity of each pipeline would be 200,000 barrels (or 8.4 million gallons) per day, which would more than double the number of trains carrying volatile Bakken crude to the Port of Albany at the peak of Bakken crude production in 2014.  The increase in crude-by-rail volume means that the project will also impact many communities north and west of Albany through which the CSX and Canadian Pacific rail lines run.

VIDEO: Kingston Common Council Caucus (5/2/16) and Full Council Meeting (5/3/16)

We are pleased to bring you video from this week’s common council caucus (5/2) and full council meeting (5/3). As you will see, we have marked much of the content specifically focused on the items that we have been following recently that include amending the firearms law and the Pilgrim Pipeline memorializing resolution. However, there is a good amount of information throughout, and we encourage you to take the time to also view the remainder of the footage.

Citizens did a great job in supporting the council in their decision making process last night, and in sharing their opinions on the location of the proposed shooting range. The outcome was that the council sent the amended firearms law back to the laws and rules committee for further vetting, which was seen as a positive action by all sides. In addition, an important memorializing resolution was passed showing Kingston’s support of Bill A9831a   sponsored by Assemblyman Skartados, “an act to prevent the construction of pipelines to transport hazardous substances or petroleum on property under the jurisdiction of the New York Thruway Authority.”

IN THEIR OWN WORDS: Why Does Passing The Water Referendum on November 3rd Matter?

As part of our ongoing effort to educate citizens on the upcoming Water Referendum that will appear on the November 3rd  ballot,  we are happy to present this piece, “In their own words” to share insight from residents who live and work inside and out of the City of Kingston.

Our lives are intimately impacted by the decisions made by our elected and appointed officials on all fronts.  In this case, regarding water, by voting ‘YES’ to include the Common Council on all sales of water outside Kingston’s corporate limits, we have a real opportunity to assure better decisions to be made.

Please take note. The Water Sales Referendum will be on the BACK OF THE BALLOT on November 3rd.

Water Powers Public Hearing on Thursday, July 23rd at 10:00am

A great day. The Kingston Common Council sends the Water Powers legislation to the Mayor’s office for a final signature. The decision to do so was unanimous after each reading (there were two).

This week, many anticipate the scheduled public hearing on the Water Powers legislation on Thursday, July 23rd at 10:00am at Kingston City Hall Council Chambers (this event will be filmed).

It is the final step in the process that would include both “the Common Council and the Mayor of Kingston for any water sales outside of the City of Kingston’s corporate boundaries.”   It is expected that the mayor will sign off on the legislation on Thursday, sending it to the ballot as a referendum in November for the public to decide.

It’s our water. We are INVOLVED.

As it is currently written, Water Powers in the City of Kingston’s charter excludes an elected body (although the Mayor of Kingston does sit on the water board of commissioners)  in decision making on how the public’s water supply is sold outside of the city of Kingston. The public’s most valuable resource therefore is in the hands of about five-six people.

If the public votes in favor of the referendum this November,  water sales outside of our corporate boundary will be made with the inclusion of Kingston’s common council. This action will allow the City of Kingston a ‘seat at the table’  in the case of a SEQR review, something that we did not have and that was terribly frustrating last year.

The inclusion of the common council for water sales would give our  community a ‘discretionary decision’ to make as an involved agency in SEQR (we were only an ‘interested agency’ last fall and as you might recall, we had to fight tooth and nail for it.  That hard won status still gave us little to no authority).  As an ‘involved agency’ we would have a say in determining who the ‘lead agency‘ in SEQR would be, creating an important opportunity for the collective community voice.

Taken from the SEQR handbook:

As an ‘involved’ agency, the City of Kingston would be allowed to 

  • Make certain the lead agency understands the extent of the involved agency’s jurisdiction; and
  • Provide the lead agency with observations and concerns about the proposed action and its potential environmental impact so the lead agency may consider them in making a determination of significance.

When a lead agency has made a negative determination of significance (negative declaration) each remaining involved agency may make its final decision on the action after completing any other required procedures.

When a lead agency has made a positive declaration each involved agency could:

  • Participate in scoping, making the lead agency aware of that agency’s concerns and technical requirements identify potential significant environmental impacts and suggest alternatives and mitigation;
  • Assist the lead agency in reviewing a draft EIS for adequacy, if requested;
  • Participate in any hearings, as appropriate;
  • Provide formal agency comments during the public review period;
  • Assist the lead agency in responding to substantive comments on the final EIS, if requested; and
  • Prepare the involved agency’s own separate SEQR findings before making its final decision.

An involved agency can also influence the determination of significance by the lead agency.  All involved agencies are encouraged to submit comments during the coordination period. Comments that deal with an agency’s specific area of interest or jurisdiction are especially appropriate. 

It’s an important safeguard, particularly when municipal water is involved.

Oversight and Transparency. 

The City of Kingston is fortunate for many reasons – one of which is that it has its own water source.  In amending the charter and including the common council as a determining body in water powers, some are concerned of political antics intruding upon their sales.  But this inclusion isn’t about personalities,  as council members and those in executive office come and go.  This is about making certain that policy and the law are applied for decision making as it pertains to our water and water infrastructure.

In the spirit of community and in seeing our region prosper, with proper oversight, good science, climate change modeling and all other matters we can help to support sustainable economic development while placing the health of our watershed and the impacted communities first.

In less than a year from the time that we first heard and spoke out on our concerns of the Niagara Bottling Company’s proposal in the Town of Ulster, the public will have the opportunity to make itself  ‘involved’  in water sales outside of our ever changing community, a voice in the protection of our water supply today and for future generations.

We’ve come a very long way.

Kingston Alderman Questions Demolition of Potential Historic Properties in Kingston.

Today, Ward 3 Alderman Brad Will issued a communication to the Common Council regarding his concern of the potential demolition of what are  potentially significant historic properties in Kingston. The public is invited to attend the next Common Council meeting on Tuesday, May 5th to voice in on the following information. Having reached out to residents who are experts in the field of historic preservation, please note the following:

Attached find two reports prepared by an ACRA-Accredited archaeologist for the NYS DOT in 2002, and two current real estate market estimates.  There is some discrepancy of physical address between tax roll, Ulster GIS, and the reports, but none regarding the historical significance of both properties – constructed ca. 1810-1830.  Note on page two of each report that the subject property “meets eligibility criteria” for inclusion on both State and National Historic Registers, and that each “embodies the distinct characteristics of a type, period, or method of construction; or represents a significant and distinguishable entity whose components may lack individual distinction.”

These two structures should be saved – along with others that we will be asked to appropriate funds for destruction.  They are two hundred year old structuresthat speak to Kingston’s history – they should and can be preserved.  Properties should be re-marketed to eligible buyers (individuals or organizations) for reasonable asking prices that facilitate and encourage their preservation.  Clear and attractive identifying signage should be placed at the properties that state they are City-owned and for sale.  Absent these steps, Kingston risks losing much credibility of the marketing message stating that “Historic Is Just Our Beginning.”

Equally important will be the City developing comprehensive and public-accessible criteria to evaluate not only the structural integrity – but also the historic value and status – of any property that is being considered for demolition.  This means the City has to do its homework with SHPO, DOT, the County, Heritage Area Commission, Friends of Historic Kingston, and any other entity that may offer valuable information regarding a given property’s status.

“Infrastructure must be maintained. People come to rely on that service.  The general population doesn’t stop to think “If I didn’t have water, how would my life be affected? Last evening, KingstonCitizens.org hosted a “Water & Waste Water Infrastructure 101” educational panel with guests Water Resource Specialist Candace Balmer of RCAP Solutions and Environmental Project Manager Fred Testa from NYS Environmental Facilities Corporation.

Close to 50 people were in attendance that included elected and appointed officials, representatives from many of our environmental organizations and citizens alike.

Instead of it being $2 million dollars it’s more like $6 million in longterm costs.”

“People don’t always understand where their dollars are going, (chemicals, transmission, admin, debt repayment, etc.). It’s about getting the most value for your equipment. It costs more to fix something once it’s broken than when it was planned for so to be replaced in a timely manner.  Assets are pipes, buildings, tanks, equipment, security, tools, office/lab. These are things that you have invested in and you recognize that they have a life span and when they break, you want to make sure that you have access to the things that you need to replace them efficiently and think of about financing for these replacements beforehand.  The first thing you do is an inventory. You want to identify what your assets are and prioritize your critical assets. Those that you’ll be really in trouble if you don’t have a back-up or money in the kitty for replacement.  Many communities don’t have maps. It’s very important to know what and where these assets are. What’s the expected use for life of an asset and how much does it cost? You’ve got to be saving money and setting it aside in dedicated accounts.”

I think Kingston has projects listed in the drinking water plant, but not waste water. The City received funding last September for a study 30,000 to study the engineering planning grant WW treatment plant for improvements. They can then give us a listing form, get on the intended use plan and get a score to hopefully be high enough to apply for hardship financing.   Projects can apply for up to $25 million, $18 million at 0%  The city is not in a position to apply because they are not on the list. Step one. Get on the list.

“Troubled that we are talking about conventional waste water treatment plants. They don’t include pharmaceuticals, heavy metals, hormones. However newer technologies methods do. “Looking at it from a community perspective, what EPA has promoted is decentralized water management concept with responsible management entity. Pay the bills. You can have a management district that manage onsite. Woodstock has a management area where they inspect and repair individual septic systems. There’s a variety of ways. For individuals, there are not a lot of programs. If you are poor or elderly you can get up to 7500 in a lifetime and septic systems are one of them that you can use it for.”

Jobs: Urban Agriculture and Niagara Bottling Co.

Niagara Bottling Co. wants to come to the area (tax free) to bottle and to sell 1.75 million gallons of Kingston City Water (Cooper Lake) per day. The Water may be tax free too. It is unclear whether or not that to be the case at this time.

The City of Kingston’s Water Department has provided a ‘will share’ letter to the project, but has not yet negotiated a rate (probably because they can’t without the Common Council’s permission).

With an estimated 260 trucks per day coming and going out of the site! That’s a lot of trucks.

According to their proposal, ALL FOR 160 JOBS when the facility is working at full capacity.

LOOK HERE. Based on an Urban Agriculture study that was created specifically for Kingston, the City of Kingston has approximately 800 acres of zoned ‘vacant’ land in Kingston. With just 35 acres working for us inside the city, we would create approximately 156 jobs. Kingston is way ahead of the curve on the Urban Ag front in the Hudson Valley, too.

We can do this, Kingston.

KingstonCitizens.org will host a public educational forum and discussion on “City Administrator and City Manager Forms of Government” on Tuesday, March 25th at the Kingston Public Library 55 Franklin Street, in Kingston NY from 6:00pm – 8:00pm.  Panel guests include Meredith Robson, City Administrator of the City of Beacon, NY and Chuck Strome, City Manager of New Rochelle, NY. 

Kingston, NY –  For the past twenty years, the city of Kingston, NY has what is known as a ‘Strong Mayor’ form of government, where a mayor is elected into office based on popular vote to manage the city’s $36+ million dollar budget, departments, committees, commissions and an aging citywide infrastructure.

KingstonCitizens.org is pleased to present a public educational forum and discussion on two alternative forms of government titled “City Administrator and City Manager Forms of Government” on Tuesday, March 25th from 6:00pm – 8:00pm at the Kingston Public Library located at 55 Franklin Street in Kingston, NY. All are welcome to attend.

Guest panelists include Meredith Robson, City Administrator of the City of Beacon and Chuck Strome, City Manager of New Rochelle, NY to discuss their roles and relationships with the public and elected officials.

Meredith Robson, City of Beacon Administrator:   Meredith Robson has served in a variety of governmental positions for over 26 years.  She has served in all levels of government, except County government, and her career has spanned three states.  She is currently the City Administrator for the City of Beacon. Ms. Robson has been very active in professional associations throughout her career, including serving on the New York State Conference of Mayors and Municipal Officials Executive Committee and in her current roles as President of the New York City/County Management Association and Northeast Regional Vice President for the International City/County Management Association. Ms. Robson is an ICMA Credentialed Manager and has a Bachelor of Science from Southern Illinois University and a Master of Public Administration from John Jay College of Criminal Justice.  She has participated in numerous professional development programs, including the following leadership training opportunities:  Wallkill Valley Community Leadership Alliance, Leadership Greater Waterbury and Pace University Land Use Leadership Alliance Training Program.

Chuck Strome, New Rochelle, NY City Manager On November 12, 2002, the City Council unanimously approved the appointment of Charles B. “Chuck” Strome, III as City Manager. Mr. Strome served as Acting City Manager since March 2002 and as Deputy City Manager since 1995. Prior to that, he served as Director of Emergency Services from 1989 through 1992, and then became Assistant City Manager / City Coordinator. 

Mr. Strome has a Bachelor of Arts in Journalism and Communications from Washington and Lee University in Lexington, Virginia, and a Masters of Public Administration-Government from Pace University. 

Before joining government, Mr. Strome held positions at Hudson Westchester Radio where he was News Director, Vice President, and Program Director. 

Mr. Strome is a member of the International City Managers’ Association, and former president of the New York State City / County Managers Association. He is also past President, Vice President, and Secretary of the Municipal Administrators Association of Metropolitan New York.

Before moving to Ulster County, she worked in Washington, DC at the World Bank and Urban Institute, at the University of Rome (Italy) and as a project manager of design and construction for New York City’s major cultural institutions. Berky has lived for extended periods in Argentina, Chile, France, Israel, Italy, and Spain. She earned a B.A. in Art History from SUNY Stony Brook and Masters’ degrees in Urban Planning (M.Phil.) and Real Estate Development (M.S.) at Columbia University, where she is also currently completing a Ph.D. in Urban Planning on the subject of environmental economics.

 

A Farm Grows in Kingston

Kingston Land Trust partners Diane Reeder (The Queens Galley) and Diane Davenport (Binnewater Ice)  approved the mission and business plan for turning the South Pine Street Garden into a ‘Farm’ under the stewardship of Farmer Jesica Clark.

Community outreach and a press release will be available in the coming months. In the meantime, Jesica will begin preparing the plot in it’s entirety to include erecting a fence, doing soil tests, bringing in compost and other augmentation and trimming/removing trees in preparation for planting in 2011.

A working mission, partnerships and collaboration and bio of Farmer Clark is below. The garden name will change to reflect the farm’s mission.

This is exceptional news for the garden movement in the City of Kingston.

Mission

The South Pine Street Garden will serve as a model of urban agriculture for the city of Kingston and beyond.  A small scale market garden will show that agriculture can thrive in an urban environment and the site will be a place of learning as well as teaching for community organizations, businesses and schools.

Partnerships, Collaboration, Community

The garden and its growers will work in partnership with individuals and organizations in the community to achieve a garden and food based network.   Partnerships include: Binnewater Ice Company, The Queen’s Galley and the Operation Frontline Program, the community (*) and the Kingston Land Trust.

In particular, an extraordinary partnership between the garden and the upcoming restaurant “Rosemary” is planned wherein the garden would provide featured produce to this high profile, innovative Kingston restaurant and the garden would also serve as a learning space for the restaurant staff.

(*)  We will encourage members of the community to participate in the garden through volunteerism, workshops and organized garden “work and play” parties.

Farmer Jesica Clark Bio

Jesica Clark has worked in farming and small scale agriculture for eight years.  She has organized community gardens, managed a small diversified farm in the Hudson Valley and worked for several for-profit as well as not-for-profit, educational farms.  Having grown up in New York City and apprenticed in central Pennsylvania, she has experience in both urban culture and rural living. She is comfortable working with all members of a community and feels that good food is integral not only to physical health but also to social health.

A Call For Citizen Input: Redesigning the I-587 & Albany Avenue Intersection

The Ulster County Planning Board is seeking citizen participation. Here’s the scoop:

The focus of this meeting is to hear from you about improving the intersection at I-587 and Albany Avenue/Broadway to help traffic flow, maximize safety, and enhance this vital gateway to the city.

The objective of this public meeting will be to gather ideas and issues from the community in order to form a vision for a plan for intersection improvements. Part of this meeting will be a “hands-on” interactive workshop to collect ideas from the public for further evaluation by the study team. We want to hear from the community to target key areas of concern in this intersection study area.

Imagining ‘Pop-up Stores’ in Kingston

Designers are beginning work on creating “fantasy” retail spaces on Main Street, which will be open to the public for a month.
